Below is our policy regarding cancellations, refunds, and returns for services provided through our platform, which connects clients with freelancers for website development, WordPress services, video editing, graphic designing, and other creative services.
1. General Terms
- Service Scope: All services provided by freelancers on our platform (website development, WordPress services, video editing, graphic designing, etc.) are subject to the individual agreement between the client and the freelancer. SoMind Media facilitates the transaction but does not directly provide the services.
- Contractual Agreement: By accepting a proposal, both the client and freelancer enter into a contract under which specific terms are agreed upon. It’s important to review the terms and deliverables before finalizing the agreement.
2. Cancellation by Clients
- Before Work Commences: Clients may cancel a project at any time before the freelancer begins work, and a full refund will be issued, minus any applicable administrative fees (if mentioned in the agreement).
- After Work Commences: Once the freelancer has started work on the project, cancellations will be subject to the following:
- Partial Refund: If cancellation occurs after the freelancer has started working but before the project is completed, a partial refund may be offered depending on the amount of work completed. The refund amount will be agreed upon between the client, freelancer, and SoMind Media.
- Non-refundable Deposit: If a deposit has been paid upfront, this deposit is generally non-refundable once the work has begun, unless otherwise agreed upon.
- Notification Period: Clients must notify both the freelancer and SoMind Media of cancellation requests at least [X] days in advance.
3. Cancellation by Freelancers
- Before Work Commences: Freelancers may cancel a project before beginning work without any financial penalty. Any initial deposits will be refunded in full to the client.
- After Work Commences: Freelancers are expected to fulfill the terms of the agreement. If a freelancer needs to cancel after starting the project, they must:
- Provide written notice to both the client and SoMind Media.
- Return any payments received if the work is incomplete or not delivered according to the agreement.
- If the cancellation is due to unavoidable circumstances (e.g., illness or personal emergency), both parties will discuss and mutually agree on the next steps.
4. Refunds for Disputes
- Disputed Services: If a client is dissatisfied with the services rendered, they must raise the concern within 7 days of receiving the work. SoMind Media will mediate between the client and freelancer to resolve the issue.
- If the issue is resolved in the client’s favor, a partial or full refund may be issued.
- Refunds may not be issued if the work was delivered according to the agreed terms and the client’s feedback was not provided in a timely manner.
5. Freelancer Guarantees and Revisions
- Revision Policy: Freelancers are encouraged to include a specific number of revisions in their proposals. If additional revisions are required, they may be subject to extra charges as agreed upon in the original contract.
- Work Quality Guarantee: Freelancers are expected to deliver work that meets the client’s specifications. If the delivered work does not meet the outlined expectations, the client can request revisions or a partial refund, depending on the nature of the issue.
6. Dispute Resolution
- Mediation: In the event of a dispute between a client and a freelancer, SoMind Media offers mediation services to resolve the issue fairly. Both parties are encouraged to communicate and work together to reach a mutually agreeable solution.
- Arbitration: If the mediation does not lead to a satisfactory solution, SoMind Media may recommend arbitration to settle the matter. Both parties agree to abide by the decision.
7. Non-Refundable Services
Certain services or custom requests may be considered non-refundable due to the nature of the work, including:
- Custom-built websites or features.
- Special requests for graphic design or video editing where significant work has already been completed.
- Digital products or services that are provided and consumed immediately.
8. Administrative Fees
SoMind Media reserves the right to charge an administrative fee for cancellations or disputes that require significant involvement or time to resolve. The fee will be clearly outlined at the time of the agreement and will be communicated to both the client and the freelancer.
9. Amendments to the Policy
SoMind Media reserves the right to amend this policy at any time. Any changes will be communicated to registered clients and freelancers via email or through our platform. Continued use of our services implies acceptance of the updated terms.
